Scope of this policy

This policy describes how Machinified BV collects, uses, consults or otherwise processes an individual's personal data in the context of providing part manufacturing services (hereafter the "Service").

This policy includes a description of your data protection rights, including a right to object to some of the processing activities we carry out.

In this privacy policy, Machinified BV, "we" or "us" also refers to its affiliates. We are a company registered in Belgium, having its registered seat at Ambachtenlaan 16 3001 Heverlee, Belgium

We will process your personal data as a data controller.

This policy is to be read as consistent with the General Terms and Conditions, relating to the Service.

For the purpose of this policy, the following term "Data Protection Legislation" shall mean the Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the "GDPR"), as well as any legislation and/or regulation implementing or created pursuant to the GDPR and the e-Privacy legislation, or which amends, replaces, re-enacts or consolidates any of them, and all other national applicable laws relating to processing of personal data and privacy that may exist under applicable law.

For the purpose of this policy, "controller", "processor", "third party", "supervisory authority", "personal data", "processing", "data subject", shall have the meanings set out in the applicable Data Protection Legislation.

 

What information do we collect?

Through the Service, we collect personal information that identifies you directly from you, such as when you sign up to our newsletter, register a product, visit our premises or otherwise contact us. The types of information we may collect from you include:

  • Identifiers, such as your name, telephone number, physical and/or email addresses, IP address, account username, and account password.
  • Commercial information, such as details about your subscription plans, the Service you have purchased, used and/or expressed interest in, and/or events you have attended.
  • Financial account information, such as payment information you provide when making a purchase of or through an offering (for direct online payments, a third party processes these transfers on our behalf as described below).
  • Protected characteristics, such as your date of birth (where applicable).
  • Additional information, such as your signature; records of our interactions, such as correspondence, details of complaints and their resolutions; your preferences, including your preferred products, language, and the frequency at which you wish to receive marketing communications.

When you make purchases through our websites, we use a payment processor (Stripe) and do not store credit card or other financial information (other than confirmation that payment in a certain amount has been made). We collect contact and account information from you that we pass through to the payment processor to facilitate the transaction. For more information you can contact our providers as set forth in their privacy notices.

We may also generate additional information based on your (online) interactions with us, which we may associate with your account. This information includes:

  • Unique user or device identifiers, IP address and cookie identifiers.
  • Internet or electronic information, such as your user journey on our website or posts, discussions, and other types of engagement with us, including on our social media channels.
  • Commercial information, such as records about interest in our offerings or completed purchases.

 

How do we use the information we collect about you?

Machinified will not use your personal information for any purpose other than the purpose for which it was originally obtained, unless we obtain your explicit prior consent to do so. We use your personal information mindfully, and for the following purposes:

  • To provide support regarding our Service;
  • To fulfill our contractual obligations towards you as our customer;
  • To respond to your questions, comments and complaints;
  • To process and complete your orders;
  • To send you relevant promotional offers or similar marketing communications where we are legally able to do so;
  • To send you important information regarding your account, purchases or other interactions with us;
  • To understand the ways our offerings are used and who is using them in furtherance of our legitimate interest in improving our offerings and the overall user experience or, where needed, with consent;

How long is your personal data stored?

We will retain your information only for the period necessary to fulfil the purposes outlined in this Privacy Statement unless a longer retention period is required by applicable law.

 

How is your personal data shared with third parties?

We only share with or disclose information to third parties to perform the Service as described in this policy. When we transfer your information, we require all our service providers to maintain the privacy, confidentiality and security of personal information and data. We use third party service providers to perform functions or services on our behalf. Is your personal data transferred outside the European Economic Area (EEA)?

In the context of the provision of the Service and for the purposes described in this policy, your personal data will be kept within the EEA.

 

What are your rights?

Once you have provided your personal data, several rights are recognized under the Data Protection Legislation, which you can in principle exercise free of charge, subject to statutory exceptions. In particular, you have the following rights:

  • Right to withdraw consent: if your personal data is processed on the basis of you consent, you have the right to withdraw your consent at any time you choose and on your own initiative. The withdrawal of your consent will not affect the lawfulness of the collection and processing of your data based on your consent up until the moment where you withdraw your consent.
  • Right to access, review, and rectify your data: you have the right to access, review, and rectify your personal data. You may be entitled to ask us for a copy of your information, to review or correct it if you wish to review or rectify any information like your name, email address, passwords and/or any other preferences, you can easily do so by contacting us at info@machinified.com. You may also request a copy of the personal data processed as described herein by sending an email to info@machinified.com You can access and review this information and, if necessary, ask to rectify your information.
  • Right to erasure: you have the right to erasure of all the personal data processed by as described herein in case it is no longer needed for the purposes for which the personal data was initially collected or processed, in accordance with the Data Protection Legislation.  
  • Right to object or restriction of processing: under certain circumstances described in the Data Protection Legislation, you may ask for a restriction of processing or object to the processing of your personal data.
  • Right to object to processing for direct marketing: where your personal data is processed for direct marketing purposes, you may object to such processing.
  • Right to data portability: you have the right to receive the Personal Data processed in a format which is structured, commonly used and machine-readable and to transmit this data to another service provider.

These rights may be limited, for example if fulfilling your request would reveal personal data about another person, or if you ask us to delete information which we are required by law to keep or have compelling legitimate interests in keeping.

What security measures are put in place?

Appropriate technical and organisational measures are implemented in order to ensure an appropriate level of security of your personal data.

In the event personal information is compromised as a result of a security breach and where the breach is likely to result in a high risk to the rights and freedoms, we will make the necessary notifications, as required under the Data Protection Legislation. 

 

What rules apply to children?

The Service is not intended for use by anyone under the age of 18. We do not knowingly collect of solicit personal data from anyone under the age of 18 or knowingly allow such persons to register for the Service.

 

Does this policy apply to third party websites?

If you click on a link to a third party website, you will be taken to a website we do not control. This policy is only in effect for the Service and not for any third party website and you are subject to the terms of use and privacy and other policies of such third party website. Read the privacy policy of other websites carefully. We are not responsible or liable for the information or content on such third party websites.

We may also include content, pixels, tags, buttons, or other tools that link to another company’s services and/or platform(s) (“Plugins”). If you use one of our offerings that contains Plugins, information can be transferred directly from your device to a third-party provider of services and/or platforms. We may not control the data collected by Plugins. If you are logged in to a social network, the social network may be able to link your use of our offering to their services and/or platform.

For example, if you interact with a Plugin by clicking on "Like," "Follow," or "Share," or by writing a comment, this information may automatically appear in your profile on the relevant social network service or platform. Even if you are not logged in, the Plugins may send your IP address to social network services and/or platforms. Please note this when using our offerings.

When you connect to a social networking service or platform on a device that is also used by others, these other users may be able to see information that is stored or displayed in connection with your profile on the social networking service page.

We reserve the right to modify and update this privacy policy from time to time. We will bring these changes to your attention should they be indicative of a fundamental change to the processing or be relevant to the nature of the processing or be relevant to you and impact your data protection rights.
